Terms of Service
The terms for booking and staying in a Prague Prime Stays serviced apartment in Prague, including payment, house rules, and liability.
These Terms of Service ("Terms") govern your use of the Prague Prime Stays website and your booking of short-term serviced-apartment accommodation in Prague, Czech Republic. They form a binding contract between you (the "Guest", "you") and the operator (the "Operator", "Prague Prime Stays", "we", "us"). Please read them carefully before you make a booking. By completing a booking you confirm that you have read, understood, and agreed to these Terms, to our Cancellation Policy, and to our Privacy Policy.
1. Who we are
The accommodation and this website are operated by:

2. Definitions
In these Terms, the following words have the meanings set out below:
- Apartment means a short-term serviced apartment offered by Prague Prime Stays for booking through the website.
- Booking means a reservation of an Apartment for specific dates made by you through the website.
- Cancellation Policy means our Cancellation Policy, which forms part of these Terms.
- Beds24 means the third-party booking and channel-management provider through which we manage availability, reservations, and (together with Stripe) payment for direct Bookings.
- Stripe means the third-party payment-services provider whose hosted checkout, operated via Beds24, processes the card payment for your Booking.
- House Rules means the rules for staying in an Apartment set out in section 12, which form part of these Terms.
- Privacy Policy means our Privacy Policy, and Cookie Policy means our Cookie Policy.
- Processor means a third-party service provider that processes personal data on our behalf and on our instructions, as described in the Privacy Policy.
- Stay means the period of accommodation, between check-in and check-out, covered by a confirmed Booking.
3. Scope of these Terms
These Terms apply to:
- the use of the Prague Prime Stays website; and
- the booking and provision of short-term accommodation in Apartments offered by Prague Prime Stays.
Prague Prime Stays offers direct bookings only through this website. If you booked one of our Apartments through a third-party platform (for example Airbnb or Booking.com), your contract is governed by that platform's terms, and those of its host arrangement, rather than by these Terms.
4. How a booking is made
The booking flow on the website is as follows:
- you search for availability and select an Apartment for your chosen dates;
- you enter your guest details (first name, last name, email, phone number, country of residence, and an optional note);
- you pay; and
- you receive a booking-confirmation email.
A contract for your Stay is concluded only when the Booking is confirmed following successful payment. Selecting an Apartment, entering your details, or starting the payment process does not by itself create a binding reservation. The confirmation email we send after successful payment marks the moment the contract is formed and sets out the key details of your Stay.
We may decline or cancel a Booking before it is confirmed - for example where an Apartment is no longer available, where details appear incorrect or fraudulent, or where payment is not completed. If we cancel a confirmed Booking for reasons attributable to us, we will refund any amounts you have paid for that Booking.
You must be at least 18 years old and have the legal capacity to enter into a contract in order to make a Booking. [Age threshold to be confirmed before launch.]
5. Price and payment
- All prices are shown and charged in euro (EUR).
- The full price of your Stay is charged at the time of booking. Payment is taken as a single charge equal to the nightly total for your selected dates.
- Payment is processed through a Stripe hosted checkout that is operated via our booking and channel-management provider, Beds24. Beds24 acts as the merchant for the card transaction. You enter your card details directly on Stripe's secure hosted checkout pages. ** Prague Prime Stays never receives, sees, or stores your card details.**
- The price displayed at checkout is the price for the accommodation for the dates selected. As confirmed by our current booking process, there is no separate charge in the booking flow for tourist or accommodation fees, cleaning, a security or damage deposit, or add-ons. Where any such amounts apply, they are addressed in sections 6 and 7 below.
- VAT: where value added tax (DPH) applies to the accommodation, the price shown at checkout is inclusive of it. Our VAT registration status is shown in section 1. [VAT treatment to be confirmed before launch; if Prague Prime Stays is not VAT-registered, no VAT is charged.]

6. Local accommodation fees and taxes
Local accommodation fees, such as the Prague accommodation fee (mistni poplatek z pobytu), may apply to overnight stays where required by law. The amount of any such fee is set by municipal ordinance and may change over time.
[Handling to be confirmed before launch.] Whether and how any local accommodation fee is collected has not yet been decided. It is not currently collected through the website booking flow. If a local accommodation fee applies to your Stay, we will inform you of the amount and the method of payment at or before check-in. Nothing in these Terms should be read as a statement that such a fee is already included in the price shown at checkout.
7. Security or damage deposit
A refundable security or damage deposit may be required for certain stays. Where a deposit applies, the amount and the conditions for its return are confirmed at or before check-in. [To be confirmed.]
A deposit is not charged through the website booking flow. Any deposit, where it applies, is handled separately from the online payment described in section 5. Where a deposit is taken, we may apply it towards the cost of damage, missing items, excessive cleaning, breach of the House Rules, or unpaid charges, and we will return the balance to you after your departure in accordance with the conditions communicated at or before check-in.
8. Right of withdrawal (distance contracts)
Your Booking is a contract for accommodation provided on a specific date or within a specific period. Under Czech law (Obcansky zakonik, zakon c. 89/2012 Sb., sec. 1837(j)) and the EU Consumer Rights Directive 2011/83/EU, Art. 16(l), such contracts are exempt from the 14-day right of withdrawal that normally applies to distance and off-premises contracts concluded with consumers.
This means that by booking a Stay for specific dates you do not have a statutory 14-day "cooling-off" or withdrawal period. Instead, changes and cancellations are governed entirely by our Cancellation Policy, which forms part of these Terms.
9. Cancellations, changes, and refunds
Our full cancellation terms are set out in the Cancellation Policy. In summary:
- 14 or more days before check-in: free cancellation with a full refund.
- 7 to 13 days before check-in: the first night is non-refundable; the remainder is refunded.
- Fewer than 7 days before check-in, or no-show: the full Stay is charged and no refund is due.
- Early departure: the remaining (unused) nights are non-refundable.
- Long stays of 28 nights or more: separate terms apply - please contact us directly.
How cancellations are processed:
- A self-service cancellation link (secured by a unique token) is available when 14 or more days remain before check-in. This link processes a full refund only.
- Within 14 days of check-in, the self-service link is not available. To cancel, you must contact us at hello@workstay.cz, and our team will then apply the tiered amounts above. Refunds within 14 days are not automatic.
Refunds are issued to your original payment method via Stripe (processed through Beds24) and typically reach you within 5 to 10 business days, depending on your bank or card issuer.
If you need to change the dates of a confirmed Booking, please contact us. Changes are subject to availability and to the Cancellation Policy, and are not guaranteed.
10. Booking provider and payment processing
We rely on third-party providers to operate our direct booking and payment process:
- Beds24 manages availability, reservations, and channel synchronisation, and operates the payment integration described in section 5.
- Stripe processes the card payment through its hosted checkout, operated via Beds24.
These providers run their own systems and are governed by their own terms. Their availability, processing times, security measures, and technical performance are outside our direct control. While we choose providers we consider reliable, we are not responsible for outages, delays, errors, or downtime of Beds24 or Stripe, except to the extent any liability cannot lawfully be excluded or is the result of our own failure. If a technical problem with a provider prevents a Booking, payment, or refund from completing, please contact us at hello@workstay.cz and we will work with you to resolve it. How these providers process your personal data is described in our Privacy Policy.
11. Force majeure
Neither you nor we are responsible for a failure or delay in performing obligations under these Terms that is caused by an event beyond the reasonable control of the affected party (a "force majeure event"). Force majeure events include, for example, severe weather, fire, flood, utility or internet outages, failures of third-party providers, building emergencies or structural issues outside our control, public-health measures, strikes, civil unrest, and acts or orders of public authorities.
If a force majeure event prevents us from providing a confirmed Stay, we will let you know as soon as reasonably practicable and, where possible, offer you alternative dates or a comparable Apartment. If no acceptable alternative can be arranged, we will refund the amounts you paid for the affected nights that cannot be provided. Beyond such a refund, neither party is liable to the other for loss or damage arising from a force majeure event. This section does not affect any mandatory statutory rights you have as a consumer.
12. Check-in, check-out, and House Rules
The following House Rules apply to every Stay and form part of these Terms:
- Check-in is from 15:00.
- Check-out is by 11:00.
- Early check-in and late check-out are available on request and are subject to the cleaning schedule.
- Quiet hours are 22:00 to 08:00.
- No smoking anywhere inside the Apartment.
- No parties or events. The Apartments are in residential buildings and gatherings are not allowed.
- Maximum occupancy: only the number of guests listed on the Booking may stay overnight.
- Day visitors are welcome until 22:00.
- Pets are not permitted. Registered service animals are welcome on request.
- Lost keys incur a replacement fee. Please return all keys at check-out.
We may refuse access, or require a guest to leave without refund, where there is a serious or repeated breach of these House Rules, where the safety of the property or other residents is at risk, or where the Booking is being used in a way that is unlawful or materially different from what was booked. You are responsible for the conduct of everyone in your party.
13. Your obligations
You agree to:
- provide accurate and complete booking and guest information;
- use the Apartment with reasonable care and only for residential accommodation purposes;
- comply with these Terms, the House Rules, and any reasonable instructions provided for the Apartment or building;
- report any damage or fault promptly; and
- complete any registration or identification steps required by law (see section 14).
You are responsible for any damage to the Apartment, its contents, or the building that is caused by you or by members of your party beyond fair wear and tear.
14. Foreign-guest registration (legal obligation)
As an accommodation provider in the Czech Republic, we are required by law (zakon c. 326/1999 Sb.) to record information about foreign guests, including full name, date of birth, nationality, travel-document (passport or ID) number, address, and the dates of stay. We must keep this record for six years, and it may be reported to the Czech police, including via the UbyPort system. This processing is carried out to comply with a legal obligation (GDPR Art. 6(1)(c)).
The online booking form does not collect your passport number, date of birth, or home address. This information is collected separately, at or before check-in. You agree to provide it when requested so that we can meet this legal obligation. How we handle this data is described in our Privacy Policy.
15. Apartment descriptions and website content
We take care to describe and depict our Apartments accurately. Photographs, floor plans, amenity lists, and location information are provided for guidance and may show items or finishes that vary slightly between Apartments or over time. Some alternative ("alt") text and captions for apartment photographs are generated with the assistance of an AI tool; this affects descriptive text only and does not change the Apartment you book.
Apartment pages may display a map embedded from Google Maps. Loading that map involves Google and may set Google cookies; see our Cookie Policy for details.
We may correct obvious errors in pricing or descriptions. If an error materially affects your Booking, we will contact you and, where appropriate, offer you the option to confirm the corrected Booking or to cancel for a full refund.
16. Liability
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud, and any mandatory liability under applicable consumer-protection law.
Subject to the paragraph above:
- we are not liable for loss or damage that was not reasonably foreseeable, or that arises from a force majeure event as described in section 11;
- we are not responsible for the loss of personal belongings left in the Apartment; and
- where we are found liable for a Booking, our total liability for that Booking will not exceed the total amount you paid for the Booking in question.
These limitations do not affect your mandatory statutory rights as a consumer.
17. Personal data
We process personal data in connection with your Booking and your use of the website as described in our Privacy Policy. The Privacy Policy explains what data we collect, the legal bases we rely on, the service providers (Processors) we use, how long we keep data, and your rights under the GDPR. Cookies and similar technologies are described in our Cookie Policy.
18. Complaints and out-of-court dispute resolution
If something is not right with your Stay, please contact us as soon as possible at hello@workstay.cz so that we can try to resolve it quickly.
If we are unable to resolve a consumer dispute directly, you have the right to use out-of-court dispute resolution. The competent body for accommodation services is:

Using out-of-court dispute resolution does not affect your right to bring a claim before a court.
19. Governing law and jurisdiction
These Terms and any contract for your Stay are governed by the law of the Czech Republic. If you are a consumer resident in the EU, you also benefit from the mandatory consumer-protection rules of your country of residence, and nothing in these Terms deprives you of the protection those mandatory rules provide.
Disputes are subject to the jurisdiction of the competent Czech courts, without prejudice to any mandatory rules that allow a consumer to bring proceedings in their country of residence.
20. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in our services or in applicable law. The version of the Terms in force at the time you make a Booking is the version that applies to that Booking. The "Last updated" date shown on this page indicates when the current version took effect.
